Trade mark applications have changed considerably as a result of the Trade Marks (Bailiwick of Guernsey) Ordinance, 2006. Applications for a trade mark in Guernsey are no longer required to be supported by a registration in the United Kingdom, although re-registration of a UK trade mark is also a service made available to proprietors.

Direct filing for First Registrations is now possible with the Intellectual Property Office.

Trade marks registered in the Bailiwick of Guernsey will receive protection within the jurisdiction for a period of ten years, after which time applications for renewal can also be made.

At present CTM registrations from Guernsey cannot be accepted by OHIM but consultation is currently underway in order that both for European and International registrations (through the Madrid System) may be extended to the Bailiwick of Guernsey.
