Patents
At present (January 2007) the process of applying for patents in the Bailiwick of Guernsey continues to be through application to The Royal Court in the Island which requires the services of a legal representative. The legislation governing this activity is currently under review and in due course the results will be available at www.gov.gg/ipo.
Scope for the inclusion of Innovation Warranties is also being included in this review.
Until the new legislation is enacted in the Bailiwick of Guernsey, if you apply for a patent based on an existing United Kingdom patent, at any time after the UK date of issue, registration would normally be granted, the patent will expire with the UK patent.
EP(UK)
If you apply for a patent based on an existing EP (UK) patent, at any time after the EP(UK) date of issue, registration would normally be granted, the patent in The Bailiwick of Guernsey will expire with the EP(UK) patent.
